Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and RedCurtain.ai (“RedCurtain,” “we,” “us,” or “our”) governing your access to and use of the RedCurtain website and services (the “Service”). By accessing or using the Service you agree to these Terms and to our Privacy Policy and Content & Conduct Policy. If you do not agree, do not use the Service.
1. Adults only — eligibility
The Service is strictly for adults and contains sexually explicit, AI-generated material. You represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is greater), that it is legal for you to view adult content where you live, and that you have the legal capacity to enter into these Terms. We may require age or identity verification and may refuse or revoke access at our discretion.
2. What the Service is
RedCurtain lets you design fictional characters and generate images, videos, and text conversations of them using artificial intelligence. Every character is fictional and computer-generated. Characters do not depict, and are not intended to depict, any real, identifiable person. Any resemblance to a real person is coincidental and unintended.
3. Your account
You may use the Service anonymously or create an account with an email and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. You must provide accurate information and may not share, sell, or transfer your account.
4. Your prompts and generated content
“User Content” means the prompts, character settings, messages, and other inputs you submit, and the images, videos, and text the Service generates from them. As between you and us, you own the outputs you generate, to the extent such outputs are capable of ownership under applicable law, subject to these Terms and the rights of our providers.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to operate, secure, and improve the Service and to comply with law. You are solely responsible for your User Content and represent that it does not violate these Terms, our Content & Conduct Policy, or any law or third-party right.
5. Nature of AI-generated content
Outputs are produced by automated models and may be inaccurate, unexpected, or offensive. They are provided for personal entertainment and do not represent real events, people, advice, or facts. You use generated content at your own risk.
6. Acceptable use
You must comply with our Content & Conduct Policy, which is incorporated into these Terms. Among other things, you may not use the Service to create, request, or distribute any material that sexualizes minors, depicts a real identifiable person without authorization (including non-consensual intimate or “deepfake” imagery), or is otherwise illegal. Violations may result in immediate termination and referral to law enforcement.
7. Our intellectual property
The Service, including its software, design, branding, and content (excluding your User Content), is owned by RedCurtain.ai or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
8. Payments and subscriptions
Paid features, if offered, are billed through our third-party payment processors on the terms presented at purchase. Unless required by law or stated otherwise, payments are non-refundable. Subscriptions renew until cancelled; you may cancel at any time, effective at the end of the current billing period. Prices may change with notice.
9. Third-party services
The Service relies on third-party providers for AI generation, hosting, storage, and payments. Your use may be subject to their terms, and we are not responsible for their acts or omissions.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, for any violation of these Terms or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, RedCurtain.ai and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.
13. Indemnification
You agree to indemnify and hold harmless RedCurtain.ai from any claims, damages, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, additional notice. Continued use after changes take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of California, USA, without regard to conflict-of-laws rules. The courts of California, USA will have exclusive jurisdiction, unless a binding arbitration or class-action waiver is separately agreed and enforceable in your jurisdiction.
